Wokół zamówień publicznych. Międzygałęziowe interakcje prawne

The monograph focuses on the interplay between public procurement and administrative law. Public procurement law constitutes a legal instrument for the performance of the State's tasks within the sphere of dominium. At the same time, it provides for authoritative forms of administrative intervention in the functioning of the public procurement market, including supervision of the public procurement market and the imposition of administrative sanctions for certain infringements of the law. Administrative law, in turn, ensures the performance of tasks within the sphere of imperium. An efficient State requires the coexistence of both forms of action. The boundaries between them are not always clearly delineated, and the performance of the State's tasks is often preceded by a decision as to whether they should be carried out through authoritative or non-authoritative forms of action. This publication aims to provide an overview of issues that require such decisions, as well as of tasks whose performance necessitates the use of both legal instruments.
